Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and MicroByte Innovations FZCO (“AITally.me”, “we”, “us”) governing your use of AITally.me and related sites, apps, and services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

AITally.me is one of the AI products operated by MicroByte Innovations FZCO (“MBI”, “we”, “us”), a free-zone company in the United Arab Emirates. It is a unified interface for accessing and comparing third-party artificial-intelligence models. We do not own, build, or control the underlying models (such as those from OpenAI, Anthropic, Google, and others), and we are not affiliated with or endorsed by their providers. Available models, features, and capabilities may change, be added, or be removed at any time.

2. Eligibility and accounts

  • You are responsible for the accuracy of your account information and for keeping your credentials secure.
  • You are responsible for all activity under your account. Notify us immediately of any unauthorized use.

3. Acceptable use

You agree not to:

  • use the Service to violate any law, regulation, or third-party right;
  • submit content you do not have the right to submit, or that is unlawful, infringing, or harmful;
  • attempt to generate content that is illegal, abusive, or designed to harm others;
  • reverse-engineer, scrape, overload, or interfere with the Service or its security;
  • resell, sublicense, or provide the Service to third parties except as expressly permitted;
  • circumvent usage limits, rate limits, or access controls;
  • violate the usage policies of any underlying model provider (which apply to your use through the Service).

We may suspend or terminate access for violations.

4. Your content

  • You retain ownership of the inputs you submit (“Input”) and, as between you and us, of the outputs generated for you (“Output”), subject to the rights of model providers and to Section 5.
  • You grant us a limited license to host, process, transmit, and display your Input and Output solely to operate, secure, and improve the Service, including transmitting your Input to the model provider you select.
  • You are solely responsible for your Input and for how you use any Output.
  • Do not submit confidential, regulated, or personal data that you are not permitted to disclose to third-party processors.

5. AI outputs — important disclaimers

  • AI-generated Output may be inaccurate, incomplete, outdated, biased, or misleading, and may not reflect real facts. Always verify before relying on it.
  • Output is not professional advice (legal, medical, financial, or otherwise). Use it at your own risk.
  • The same prompt may produce different Output across models or sessions; we do not guarantee any particular result, availability of any model, or accuracy.
  • Your use of each model is also subject to that provider's terms and usage policies.

6. Subscriptions, billing, and trials

  • Paid plans are billed in advance on a recurring basis (e.g. monthly or annually) and auto-renew until cancelled.
  • Prices and plan features may change; we will give notice as required by law before changes take effect for your next term.
  • Free trials (if offered) convert to a paid plan at the end of the trial unless cancelled beforehand.
  • You can cancel at any time; cancellation takes effect at the end of the current billing period.
  • Refunds: fees are non-refundable except where required by applicable law.
  • You are responsible for applicable taxes. Payments are processed by PayPal.

7. Intellectual property

The Service, including its software, design, branding, and content (excluding your Input/Output and third-party content), is owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. The AITally.me name and logo are our trademarks; you may not use them without permission.

8. Third-party services

The Service relies on third-party model providers and other vendors. Your use of those models is subject to the relevant provider's terms. We are not responsible for third-party services, and their availability is outside our control.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY REGARDING ACCURACY, RELIABILITY, OR UNINTERRUPTED OPERATION.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MICROBYTE INNOVATIONS FZCO AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF USD 100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless MicroByte Innovations FZCO and its affiliates from claims, damages, and expenses arising out of your Input, your use of the Service, or your violation of these Terms or applicable law.

12. Suspension and termination

We may suspend or terminate your access at any time for violation of these Terms, legal requirements, or risk to the Service or others. You may stop using the Service and close your account at any time. Sections that by their nature should survive (e.g. ownership, disclaimers, liability, indemnity) survive termination.

13. Changes to the Terms

We may update these Terms from time to time. We will post the updated version with a new date and, for material changes, provide reasonable notice. Continued use after changes take effect constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates, as applied in Dubai and the IFZA, Dubai Silicon Oasis, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of Dubai, UAE, except where mandatory consumer-protection law provides otherwise.

15. General

  • Entire agreement: these Terms and the Privacy Policy are the entire agreement between us.
  • Severability: if any provision is unenforceable, the rest remain in effect.
  • No waiver: failure to enforce a provision is not a waiver.
  • Assignment: you may not assign these Terms without our consent; we may assign them in connection with a business transfer.
  • Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
